DIRECTIONS:

FROM U.S. 431 AND ROSS CLARK CIRCLE IN DOTHAN, ALABAMA:  PROCEED NORTH ON U.S. 431 TO THE TRAFFIC LIGHT IN FRONT OF NORTHVIEW HIGH SCHOOL.  TURN RIGHT ON RONEY ROAD AND PROCEED APPROXIMATELY 3 MILES TO KINSEY BAPTIST CHURCH.  TURN LEFT AT KINSEY BAPTIST CHURCH AND PROCEED APPROXIMATELY 2/10THS OF A MILE TO THE KINSEY TOWN HALL ON THE LEFT.

FROM ABBEVILLE, HEADLAND, AND POINTS NORTH:  PROCEED SOUTH ON U.S. 431 TO BETHEL ROAD.  TURN LEFT ON BETHEL ROAD AND GO TO DEAD END.  TURN LEFT ON BROAD STREET AND IMMEDIATELY BACK TO THE RIGHT ON WALDEN DRIVE.  KINSEY TOWN HALL WILL BE ON THE RIGHT.

TERMS & CONDITIONS: 

PAYMENT:  Payment for Backhoe shall be cash or check with proper photo identification.  Full payment shall be made on day of sale before leaving premises.  All checks must be made payable to the Town of Kinsey.  Buyer agrees not to stop payment for any reason as all sales are final.  We will not accept drafts.  Non Sufficient Funds checks will be subject to a Administrative Charges and prosecution where applicable.

WARRANTY:  Backhoe sold “As Is, Where Is!”  The Auctioneer assumes no liability for any guarantee made by the SELLER or the SELLER'S AGENT.  No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any property sold.  It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by SELLER, SELLER'S REPRESENTATIVE, AUCTIONEER or AUCTIONEER'S REPRESENTATIVE that are not set forth herein.

REMOVAL DATE:  Backhoe becomes the full responsibility of Buyer at the time of purchase and Buyer assumes all risk of loss or damage to backhoe until removed from sale premises.  Backhoe can not be removed from sale site until Buyer's payment has cleared the financial institution unless other arrangements are made in advance with the Town of Kinsey.

DISPUTES BETWEEN BUYERS:  The Auctioneer shall designate the purchaser after backhoe is sold.  If a dispute arises between two or more buyers, the Auctioneer reserves the right to reopen bidding.  His designation of a buyer shall be final.

RESELL:  The Town of Kinsey reserves the right to resell any property not paid for in full on day of sale.  The buyer shall be responsible to The Town of Kinsey for any expenses for resell or collections and any damages resulting from sale.

INJURY & DAMAGES:  Bidder acknowledges responsibility for any personal injury and property damage caused by bidder or his agent and further agrees to hold The Town of Kinsey harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.

SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.:  All sales are subject to sales tax laws of the State of Alabama.  It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold.  This certificate must bear your sales tax permit number.  Failure to furnish this information will require payment of sales tax on all purchases.
